English law necessitates that before any medical professional can examine or treat a patient, they must obtain informed consent to do so. Consent can be either explicit (specific consent to carry out a specific action) or implied (not expressly given by a patient, but inferred from their actions, the facts and circumstances of a particular situation, and sometimes a patient’s silence or inaction). Generally there is no legal requirement to obtain written consent but it may be advisable in some circumstances.
